Die einstweilige Verfügung gegen den Verkauf des Samsung Galaxy Tabs in Europa hat viele überrascht, selbst Samsung. Mittlerweile hat Samsung eine Stellungnahme zu der Entscheidung des Landgerichts Düsseldorf veröffentlicht.
Samsungs PR-Chef Kim Titus äußerte sich in einem Statement, dass man mit der Entscheidung des Gerichts alles andere als zufrieden sei. Er betonte, dass der koreanische Hersteller alle nötigen Schritte in Bewegung setzt, damit Samsungs Recht am geistigen Eigentum intakt bleibt. Man werde gegen den Verkaufsstopp vorgehen, um das Galaxy Tab schnellstmöglich wieder in den Verkauf geben zu können.
Aus der Stellungnahme geht hervor, dass der Antrag Apples auf einstweilige Verfügung ohne Notiz an Samsung erfolgte. Damit hatte der Konzern nicht einmal eine Chance, vorab zu reagieren. Die richterliche Anweisung wurde Samsung zugestellt, ohne dass der Konzern die Möglichkeit auf eine Anhörung oder Präsentation des in Frage stehenden Produkts hatte. Das Ganze klingt alles andere als nach einem fairen Spiel seitens Apple. Nun heißt es abwarten und hoffen, dass Samsung Recht zugesprochen bekommt.

In den größeren Shops sind die Tabs auch nicht mehr verfügbar. Wieso das? Für die Anhörung des Beklagten ist ja wohl eher das Gericht und nicht Apple zuständig!
Was soll diese Art des subjektiven Schreibens? Warum soll sich Apple nicht Kopien der Idee und des Konzeptes wehren? Warum muss ein Gericht jemanden Anhören, wenn es um einen Zeitkritischen Virgang geht? Welches Interesse sollte ein Düsseldorfer Gericht haben Apple zu bevorzugen? Mann last eure Komentare!
